A Palm Beach County Sheriff's deputy is accused of sexually assaulting a woman he was previously called to help.

Deputy Jason Nebergall is accused of sexually assaulting a woman he previously met responding with to a disturbance call at a mobile home park in July 2016.

The victim claims Nebergall showed up to her house for a second time that night and touched her sexually and attempted to assault her.

In court, Wednesday the defense argued that Nebergall returned to the victims home to check on her and that she came on to him.

According to investigators, a swab taken from the victim's chest had traces of Nebergall's DNA.

Nerbergall is on unpaid leave from the Palm Beach County Sheriff's Office.
