NEW BRUNSWICK, N.J. (AP) -- The Florida woman charged with killing her 5-year-old son in 1991 when she lived in New Jerseywill not testify.
Michelle Lodzinski told a judge on Tuesday she decided not to take the stand after speaking with her lawyer. Lodzinski wants the judge to instruct the jury that is her right and she's presumed innocent until a verdict is reached.
Lodzinski is charged with killing Timothy Wiltsey when she lived in New Jersey. The Port St. Lucie resident was arrested in 2014, a few years after prosecutors reopened the case.
The trial began in mid-March and the defense is nearing the end of presenting its case. One of its witnesses had to leave town and will return next week. Another potential witness is expected to testify from South Carolina.
