Dalia Dippolito's attorney will ask a judge this week to dismiss her attempted murder charges, claiming police mishandled her arrest.
Dippolito was previously convicted of trying to hire a hitman to kill her husband in 2009.
That verdict was later overturned because of issues with selecting a jury.
