Lamborghini driver in deadly crash gets two years' house arrest

PALM BEACH COUNTY, Fla. -- The driver of Lamborghini that killed an 82-year-old Uber driver in Delray Beach has been sentenced to two years of house arrest, according to court documents.

The Sept. 21, 2016 crash at the intersection of NE 6th Avenue and 1st Street killed J. Gerald Smith of West Boynton Beach.

According to witnesses, a yellow Lamborghini and a yellow Porsche were traveling at a high rate of speed when the Lamborghini crashed into Smith's Buick Enclave, injuring both drivers.

Police said Smith and his wife had dinner waiting for him when his SUV was hit by the speeding Lamborghini.

The driver of the Lamborghini, Roger Wittenberns, pleaded guilty to DUI manslaughter and driving under the influence causing injury to a person or property, court records show.

A police report said that Wittenberns had told a trauma nurse at Delray Medical Center that he had “a couple of drinks.”   

Surveillance video at a restaurant recorded the crash at NE Sixth Avenue and NE First Street. Crash detectives estimate the Lamborghini was going at least 75 mph.

Wittenberns was also sentenced to 10 years' probation, must pay $20,000 restitution to Smith's sons, cannot possess or consume alcohol or drugs without a valid prescription, must submit to random testing at his own expense, and has to perform 150 hours of community service, according to court documents.
