Man charged with DUI manslaughter in 2017 pedestrian death

A driver has been arrested in connection with a deadly pedestrian crash in 2017.

At 1:26 in the morning of October 6, 2017, David John Bartolino, 46, of Boca Raton, was crossing the Lantana Bridge on E. Ocean Ave., when a Mercedes Benz C280 struck and killed him, according to the Florida Highway Patrol.

The driver, identified as Mark Hirst, 57,  of Boynton Beach, refused to give a voluntary blood sample, according to an affidavit.

Hirst asked to be taken to a hospital where his blood was drawn, the Florida Highway Patrol said. Blood was also drawn based on a warrant. All of the tests showed a blood-alcohol level above the legal limit of .08, according to FHP.

A trooper wrote in a report that Hirst failed to see Bartolino crossing the road even though the pedestrian was wearing an orange reflective vest. Based on the distance of the pedestrian from the crash scene, Hirst was traveling at least 59 mph in a 30-mile zone, troopers concluded.

Hirst has been charged with DUI causing death to a human or unborn child and was booked into the Palm Beach County Jail.
