A Palm Beach County judge will not stand in the way of a run-off planned for next Tuesday.

The decision comes after a tie was declared during the Riviera Beach City District 1 City Council election in March.

Incumbent Bruce Guyton accused his opponent, Lynne Hubbard, of voter fraud and was trying to block the run off scheduled for May 17.

Circuit Judge Gregory Keyser said the evidence failed to meet the burden of proof, causing him to throw out three absentee ballots casts by Hubbard’s relatives.

Guyton wanted those ballots to be thrown out and said there was proof that Hubbard’s nephew and two brothers don’t live at her house, as listed on their voter registration.

From the beginning, Hubbard said these allegations were an attempt to detract people’s attention from the issues. She said she looks forward to the run-off.

Guyton hasn’t announced if he plans to appeal the judge’s decision.
