Wendy's 'gator tosser' gets one year probation

UPDATE:  Joshua James, the man who said he threw a gator through a Wendy's drive through window was in court Tuesday afternoon. 

James was found guilty of tossing a gator through the window. He received 1 year probation. 

A Jupiter man accused of throwing an alligator through a Royal Palm Beach Wendy's drive-thru window last year is scheduled to appear in court Tuesday afternoon.

In October, a 3.5-foot gator was thrown into the restaurant from a vehicle.    No one was hurt and the gator was released back into the wild.

Joshua James, now 24, was charged in the case, but his family claimed it was just a prank. They said he found the reptile on the side of the road and was never trying to hurt anyone.

James was charged with assault with a deadly weapon, possession of an alligator with intent to kill or injure and second-degree petit theft.

He was released from jail shortly after his arrest in February after posting $6,000 bail.
