Man in PSL jailed after singing, 'I ain't going back to jail'

An accused obscenity shouting man who sang "I ain't going back to jail," found himself behind bars after being arrested by Port St. Lucie police.

Police encountered Kirk John Tinney, 35, around 10:45 p.m. November 2 after going to the 2000 block of Southeast Avon Park Drive in Port St. Lucie for a peeping tom report.

Tinney was in the middle of the street yelling, "(Sexual intercourse) the police," and "(Sexual intercourse) those crackers," along with a racial slur and "many other offensive words," a recently released arrest affidavit states.

Police watched Tinney walk up to a vehicle's passenger side and fall off a curb. He looked back at the officers, slurring, "(Sexual intercourse) those crackers."

"The defendant was so loud that the neighbors lights came on in their homes," the affidavit states.

The booze smelling Tinney was told to go inside. There, he opened the windows and put on music, playing and singing, "I ain't going back to jail."

"I Ain't Going Back to Jail" is a song by rapper Project Pat from the 2006 album, "Crook By Da Book: The Fed Story."

The lyrics reference shooting, racial slurs, female genitalia slang and leather seats in a Chevrolet. Other tracks from the album include, "2 Dollar (Racial Slurs)," "Crack A Head" and "Raised In The Projects."

Meanwhile, police left after Tinney got a phone call and lowered the volume.

Shortly before 2 a.m. November 3, police were back after loud music complaints.

Tinney's music was "blaring," and a woman said the music constantly wakes her.

Tinney, of the 2000 block of Southeast Avon Park Drive in Port St. Lucie, was arrested on charges including disorderly intoxication and breach of the peace.
