Court orders re-sentencing for Tyler Hadley

 There will be a new sentencing hearing for Tyler Hadley, the Treasure Coast teen who killed his parents in 2011.

As reported first by TCPalm.com, the 4th District Court of Appeal ruled that "the trial court did not consider the correct alternative to a life sentence."

As a result the court ordered a re-sentencing for Hadley.

Hadley was 17 when he committed the crime. He was sentenced to two consecutive life sentences without the possibility of parole in 2014.

In its ruling the Court noted that a Supreme Court decision in 2012 determined that "mandatory life without parole for those under the age of 18 at the time of their crimes violated the Eight Amendment's prohibition on cruel and unusual punishments."

The Florida Legislature later adopted a new sentencing plan.

Hadley was sentenced in between the Supreme Court decision and the plan from the Legislature. The 4th DCA decided it had to reverse Hadley's original sentence and consider the new sentencing requirements.

Chief Assistant State Attorney of the 19th Judicial Circuit Tom Bakkedahl said he was sickened by the ruling.
