Dalia Dippolito will be retried on 2009 charges that she tried to hire a hit man to kill her then husband.
Dippolito was sentenced to 20 years in prison in 2011 after a jury convicted her of solicitation to commit murder, but an appellate court overturned the verdict.
Her attempt to avoid a retrial was rejected by the Fourth District Court of Appeal which has dismissed her appeal.
Earlier this year, Dippolito and her lawyers accused the Boynton Beach Police Department of misconduct and entrapment.
No date has been given for her new trial.
Dippolito is currently on house arrest.
