Jupiter man, 58, charged with producing child porn and having sex with a minor

The single-story home owned by Frank Smith Jr. fits right into the quiet, tree-lined Misty Lake Drive neighborhood in Jupiter. Off-white in color with a grayish-green door, the home sits behind a lawn decorated with trees and a driveway housing a white Hyundai Accent.

But inside the home, federal agents last week found a young girl — at least 40 years Smith's junior — living inside, with computers and a Panasonic web camera mounted on a tripod.

Now Smith is in custody, charged with producing child porn and enticing a minor to engage in sex.

The arrest didn't shock Smith's next-door neighbor. The woman claimed that five years ago the 58-year-old Smith tried to lure her daughter into his home. Her daughter, about 13 at the time, would watch Smith's dog while he was away.

"He asked her to give him a massage and come over," the woman, who requested that her name not be used, said Monday. "He was being inappropriate. I wanted to find out if he was some kind of pervert."

The mom called police and reported Smith. She said police told the family to stay away from him and told Smith to stay away from the young girl.

Smith was taken into custody last week on county drug charges but was then handed over to federal authorities to face the more serious charges.

The feds were alerted to possible wrongdoing by Smith in February, when, during an FBI investigation into child prostitution, a cooperating witness told federal agents that she spoke with a man named "Frankie" in Jupiter about prostituting herself.

Then last Thursday, Jupiter Police detectives contacted the FBI regarding Smith. They said they had information on a "Frank Smith" they received from West Palm Beach Police.

West Palm Beach police had been investigating a lewd battery case when a 15-year-old victim — identified as B.H. in the complaint — told authorities that she had sex with a "Frank Smith" in Jupiter.

The girl told a detective that her friend, identified as T.H., moved in with her family in August 2011. The girl said T.H. told her she worked for an escort service. T.H., about 15 at the time, introduced the girl to Smith, who was one of T.H.'s customers.

B.H. described the man to authorities as having a "big nose" and "slicked back hair" and positively identified him out of a lineup, according to the federal complaint. She also identified the Misty Lake Drive home as the home where the sex acts happened.

B.H. then told detectives that Smith would pick her and T.H. up in his white four-door Mercedes and drive them from their West Palm Beach home to his Jupiter home. He'd take them to the beach, out to dinner and on vacations to Daytona Beach. He'd let them get drunk on alcohol and high on pot and Xanax. He'd pay them between $100 and $200 to have sex with him, the complaint stated.

For about seven months, the girls answered to his demands and would do what he said while he taped it in exchange for cash.

B.H. told authorities it wasn't only she and T.H. that Smith taped — she claimed she saw videos of two other girls.

Smith told T.H. he preferred young girls, according to the complaint. T.H. often saw him searching Backpage.com, an Internet classified advertising service that police say is often used by people looking for sex.

T.H. posted an escort ad on the site and Smith responded to it, the complaint states.

Living across the street from Smith is a West Palm Beach police officer who just moved in over the weekend.

The officer, who did not want his name used, said Monday afternoon that he called the owner of the home he is renting and asked who the man is living across the street.

He said she told him Frank Smith Jr. was a friendly man. The only strange thing was that in recent years his girlfriends got "younger and younger."
