Two current Martin County commissioners and one former commissioner facing public records violations will have their day in court.

Monday morning a judge scheduled trials for former commissioner Anne Scott and current commissioners Ed Fielding and Sarah Heard.

Heard will go to trial February 19, 2018 for her non-criminal violation.

Fielding and Scott's court date is December 10, 2018.

Monday morning Heard’s attorney said the state attorney’s office still has not said what evidence they have against Heard.

“The state has not supplied to us any real evidence or anything specific to give us any idea as to what they’re alleging. So, what we did today was we asked the judge set a hearing so that we could have more information because it’s not fair to anyone to go through a proceeding where they don’t know all the allegations or the facts," attorney Barbara Kibbey Wagner said.

Fielding and Scott are facing charges of failure to allow inspection of public records, and Heard is charged with a non-criminal infraction of failure to respond to a public records request.
