Bathroom snoozer in Vero Beach has history of parking lot defecating, reports state

VERO BEACH, Fla. -- When police encountered James Raymond, he appeared to be sleeping on the potty with his pants down in a Mexican restaurant.

Vero Beach police went to the Ay Jalisco eatery in the 1900 block of 20th Street March 29 "in reference to a drunken customer who went into the bathroom and refused to leave," according to a recently released arrest affidavit.

Ay Jalisco staff told police they instructed the drunk man to leave, but said the inebriated individual still was in the men's bathroom.

Two officers went in and spied a man later identified as Raymond, 52, on the toilet with his pants down. He appeared to be snoozing.

"What do you want?" Raymond is quoted as saying when police identified themselves and told him to wake up. Police smelled booze when he spoke, and told him to hurry up because the restaurant wanted him gone.

A toilet is a common bathroom sanitation fixture typically consisting of a bowl, a hinged seat and lid and a handle for flushing. Toilets transport human excrement and toilet paper via water to a septic tank or a municipal sewage treatment facility. Of particular note for men is that women almost universally oppose the male tendency to leave the seat up after urinating. Toilets are not frequently used as beds or places of slumber.

Police "escorted" him out. At an officer's patrol car, Raymond dropped his shorts.

"He had no underwear on and his buttocks and penis were exposed," an affidavit states.
Police couldn't determine whether anyone saw Raymond nude, but reported lots of cars passed.

Much as Raymond refused to exit the Ay Jalisco latrine, he also refused to pick up his shorts.

He couldn't provide an address, but dispatchers said he gave an address in the 1000 block of 36th Avenue the last time he apparently spoke with police. Police drove Raymond to 10th Street and 36th Avenue.

"The house Mr. Raymond provided to the (Vero Beach Police Department) did not exist," an affidavit states.

Raymond was arrested on charges including disorderly intoxication and trespass on property after warning.

In an earlier arrest, Raymond was collared in April 2011 after a Hess station attendant in Vero Beach said she saw him defecating in the gas station's parking lot.

"(The attendant) confronted the defendant at which time the defendant began to yell profanity and present his genitals while shouting, 'There you go, (female dog),'" an affidavit states.

The deputy smelled booze on Raymond's breath, noting apparent "fresh human feces" in the area where Raymond was observed squatting.
