WEST PALM BEACH, Fla. - Mixed emotions for the defense as the verdict was read for Rob Lopicola, guilty on two of three charges.
"We're pleased that the jury found him not guilty of count one. Count two and three, we'll be filing some motions and an appeal if necessary," said public defender Kristy Militello.
Lopicola met the victim through a Craigslist ad. He testified he had numerous relationship with younger men, but that he never would've started this one, if he knew the victim was 15 years old.
"I do like young guys, late teens and early twenties. I have dated guys in their 30's and 40's as well, but when it comes especially to fantasy, I generally like the younger," said Lopicola.
Lopicola said the two never met in person. But the jury felt the crude text messages exchanged between them were enough to convict him for lewd and lascivious conduct and computer pornography and child exploitation.
"We'll be filing a motion to dismiss count three," said Militello.
"We're gearing up for second case it's set for a status check on Monday and we'll see what happens," said Assistant State Attorney Michael Kugler.
A court date for the second sex crimes case involving a teenager has not been set.
Lopicola will be sentenced on the charges he's been convicted of on December 6.
