WEST PALM BEACH, Fla. - Aldo Alvarez, the man investigators say was shot by off duty Palm Beach County Sheriff's deputy Joshua McGehee,  is now being represented by West Palm Beach attorney Wayne Richter.

Richter and Alvarez's parents are considering legal action after Alvarez was shot by McGehee in the deputy's driveway in Royal Palm Beach last Wednesday.

According to investigators, McGehee was defending himself and was attacked by Alvarez.

But Alvarez's parents say their son is mentally challenged and would never hurt anyone.

They told WPTV their son is bipolor schizophrenic.

Alvarez remains hospitalized after his parents say he was shot in the arms, hand, and stomach

More information about what type of legal action the family is considering is expected Friday afternoon.

Deputy McGehee remains on paid administrative leave.
