Aldo Alvarez: Man accused of attacking off-duty deputy to get another mental health evaluation

WEST PALM BEACH, Fla. - A judge ruled Monday morning that Aldo Alvarez will get another mental health evaluation to determine whether he is competent to stand trial.

The judge made the decision after she said his responses to her questions were inconsistent.

Alvarez was shot by a Palm Beach County Sheriff's deputy after the deputy says Alvarez attacked him in his driveway in May of last year.

Alvarez is schizophrenic and has no criminal history.

He was originally sent to mental health court, but later transferred out after a doctor determined he was competent to stand trial.

His attorney Wayne Richter requested to be removed from the case, but that motion was denied by the judge last week.
