Aldo Alvarez: Mentally challenged man shot by off duty deputy arrested

Investigators say deputy was defending himself

WEST PALM BEACH, Fla. - Investigators have arrested Aldo Alvarez, the man investigators say was shot by off duty Palm Beach County Sheriff's deputy Joshua McGehee, according to his defense attorney Wayne Richter.

Alvarez was shot by McGehee in the deputy's driveway in Royal Palm Beach May 8th.

According to investigators, McGehee was defending himself and was attacked by Alvarez. They say the deputy was off duty and just returned home from the gym when they say Alvarez came at the deputy in an aggressive way.

Alvarez's parents say their son is mentally challenged and would never hurt anyone.

They said their son is bi-polar schizophrenic. His parents say he was shot in the arms, hand, and stomach. He was hospitalized at St. Mary's Medical Center.

His family and attorney are worried about his condition behind bars.

"I'm concerned with him being in jail. Does he have the ability to cope there? And not because he's dangerous. But, just for somebody who's.. this was not only physically devastating for him but psychologically it gave him some trauma," defense attorney Wayne Richter said.

Alvarez faces charges of burglary with assault and battery on a law enforcement officer.

His first appearance is scheduled for Thursday morning.
