Steven Warren Barnes, the driver that stuck and killed the 3-year-old Priscilla Perez Gaspar was arrested at his residence and booked into the Palm Beach County Jail on Friday night, according to Palm Beach County Sheriff's Office.
He was charged with driving with a revoked license and causing death and vehicular homicide.
Barnes is scheduled to appear in bond court on Saturday morning.
The family of a suburban Lake Worth toddler intends to file a wrongful death lawsuit against the man the behind the wheel.
News of the impending lawsuit comes from Attorney Brian Labovic, who is now representing the family of 3-year old Priscilla Perez Gaspar. He says the suit could be filed as early as next week.
Gaspar was walking alongside Kirk Road on Monday afternoon when she was struck by a truck driven by 56- year-old Steven Barnes.
Barnes was driving on a permanently revoked license and has a history of DUI arrests dating back to 1979.
The State Attorney's Office will determine if Barnes will face charges in this case. The Gaspar family, meanwhile, is still planning for the girl's funeral.
