Ex-Rep. Allen ends appeals in sex solicitation

INDIAN RIVER COUNTY, FL -- Appeals in former state Rep. Bob Allen's sex solicitation case are over.

The seven-year lawmaker "has agreed to go ahead and move forward," his defense attorney, Greg Eisenmenger, said. "While he's maintained his innocence and is confident of his innocence, there comes a point where you just have to move on with your life, and I think that's where he's at."

Allen represented the Fellsmere and southern Brevard County area until redistricting in 2002. He is also the former executive director of the Economic Council of Martin County.

Allen was convicted in November 2007 of soliciting oral sex from an undercover police officer at a Titusville park.

He resigned a day after he was sentenced to six months of probation. He was ordered to pay a $250 fine and other costs.

The sentence was delayed pending appeals to the Brevard Circuit Court and the 5th District Court of Appeal. Both appeals were rejected.

Allen said in December that he wanted to take the case to the Florida Supreme Court. Eisenmenger said that would be "extremely difficult" because the high court chooses the cases it hears.

Allen last month paid the fine and about $500 in court costs, but he still must complete a two-hour HIV awareness course, according to the Clerk of the Court's Web site.
