Bystander hit by SWAT's ricocheted bullet

A police spokesman has identified the man who was injured as John Hicks.  He is not homeless as initally reported.

He lives nearby, was treated for a gunshot wound to the arm and released.

The officers involved in serving the warrant will NOT be placed on administrative leave.

They will be returning to their normally scheduled shifts.


WEST PALM BEACH, FL -- SWAT team members were serving a search warrant at a home near 4th Street and Division Avenue shortly before 630PM when a bullet struck a homeless bystander.

According to West Palm Beach police, an aggressive pitbull on the homeowner's property greeted police at the door.  SWAT team members tried to subdue the animal by using fire extinguishers.  When that failed, four SWAT members opened fire, killing the animal.  During the encounter however a stray shot hit a homeless man sitting on the front porch.

The homeless man's injuries were non life-threatening.  He was transported to the hospital for treatment.  Neighbors tell us the man, John Poe, was likely collecting cans from the house which he later sells for cash.
