ORANGE PARK, Fla. (AP) -- A northeast Florida man has been re-sentenced to death for stabbing his father's girlfriend about 90 times.
A Clay County judge sentenced 29-year-old Leo Kaczmar III on Friday, based on a second jury's unanimous recommendation.
Kaczmar was previously convicted of first-degree murder, arson and attempted sexual battery in 2010 and sentenced to death. The Florida Supreme County threw out the sex charge last year because of circumstantial evidence. The new sentencing was required because prosecutors listed the sex charge as an aggravating factor in why Kaczmar deserved to die.
The Florida Times-Union reports that Kaczmar attacked 49-year-old Mary Ruiz and set the house of fire in December 2008 while he was high on cocaine. After his arrest, he paid an undercover officer $300 to frame someone else for the murder.
