Liberty Medical Supply, Inc. in Port St. Lucie possibly violated WARN Act

Port St. Lucie-based company Liberty Medical Supply Inc. has filed for Chapter 11 bankruptcy protection, according to Bloomberg.com.

Liberty Medical Supply in Port St. Lucie announced in December that the company nationwide was laying off hundreds from their Port St. Lucie and Salem, Virginia companies.

The federal Worker Adjustment and Retaining Notification Act, also known as the WARN, protects workers by requiring a company to give 60-day notice when there are mass layoffs.

According to Florida 2013 WARN Notices, Liberty Medical filed on January 2, 2013, for the layoffs of approximately 250 workers, to take effect on February 16, 2013.

That's fewer than 60 days.

Liberty Medical CEO Frank Harvey confirmed that 24 or 25 workers who were scheduled to be laid off will be able to keep their jobs.

As for the other 225 that are still facing unemployment, it's only ten more days until the chopping block.
