'Disruptive' moviegoer Tasered after threatening officer at Boca movie theater, police say

BOCA RATON, Fla. -- After annoying their fellow moviegoers with obnoxious picture-taking and loud talking, two Pompano Beach brothers somehow thought it was a good idea to threaten a cop.

For their troubles, Jonathan Zapata, 24, collapsed into a heap after being Tasered and his brother Jose, 26, had his phone confiscated by police after the Sunday night dust-up in Boca Raton.

The situation began at 11:30 p.m. Sunday night when Boca Raton police officer Juan Carlos Pijuan was notified of a "disruptive" group of people inside Theater 6 at the Cinemark Theaters on Airport Road.

According to an arrest report, Officer Pijuan and a theater security guard approached Jose and Jonathan Zapata because the siblings were taking pictures with the flash on and talking loudly in the packed theater.

Officer Pijuan then turned on his flashlight to show the brothers that he was a cop. He also told them that management had the right to ask them to leave and that refusing to do so could land them in handcuffs.

Jonathan Zapata's response?

"F--- you b---- a—pig."

Pijuan again told the brothers they needed to leave.

This time, however, Jonathan Zapata, reeking of alcohol and slurring, got up from his seat and approached Pijuan in the aisle, calling the officer a "cracker motherf------ pig."

The arrest report outlines what happened next. Jonathan Zapata stood at a so-called bladed stance, which means he positioned himself with his legs at an angle as if ready to fight.

"Jonathan Zapata took a bladed stance, clenched his fists and held them at his waist and said he would 'f---' me up," Pijuan wrote in the report. "It should be noted that the theater was dark and at full capacity when this was occurring."

When it became clear that Jonathan Zapata was ignoring Pijuan's orders to back down, Pijuan drew his Taser and fired it at him. Jonathan Zapata fell to the ground, moaning. He was arrested.

Jose Zapata, who said he was recording the incident on his cell phone camera, was also arrested in the lobby after Pijuan said the camera flash was being shined in his eyes while he was trying to keep Jonathan Zapata in his custody. Pijuan knocked the camera out of Jose Zapata's hands and Jose Zapata was then arrested by another officer.

Jonathan Zapata was charged with one count of trespass after warning, assault on a law enforcement officer and one count of resisting an officer without violence.

The two were released Monday morning.
