WEST PALM BEACH, Fla. - A West Palm Beach man spent his Father's Day night at the Palm Beach County Jail after he was charged with driving under the influence and child neglect.

This morning, 43-year-old Marcos Antonio Duarte was being held at the Palm Beach County Jail in lieu of $3,000 bond.

According to the arrest report, a Palm Beach County Sheriff's deputy was on patrol around 7:41 p.m. Sunday when he noticed a four-door green Honda swerving in the middle lane of eastbound Okeechobee Boulevard. The deputy ran the car's tag, which came back registered to a white Ford pickup.

Also, the deputy documented in the report that the Honda was making "abrupt accelerations and stops."

When the deputy pulled over the car, he noticed the smell of alcohol coming from the driver, later identified as Duarte, the report stated.

A second deputy who responded to the scene, reported that a 4-year-old child was in the back seat.

When the mother arrived to pick up the boy, she told the deputies that she and Duarte were going through a divorce and that she had allowed Duarte to take their son so they could spend time together on Father's Day.

The boy, who showed no apparent injuries, was turned over to his mother.

Duarte was arrested for child neglect and driving under the influence.
