WEST PALM BEACH, Fla. -- Attorneys representing John Goodman say they are confident the polo mogul's conviction will be thrown out this week.

Defense attorney Roy Black told The Palm Beach Post Friday that he believes Goodman's sentencing hearing will not happen.

"I'm sure that by May 11 Judge [ Jeffrey] Colbath will have vacated Mr. Goodman's conviction," Black told the Palm Beach Post.

The latest motion, filed by Black, points to a book written by former juror Dennis DeMartin.

In the book, DeMartin said he conducted his own drinking experiment that helped him formulate Goodman's guilty verdict.

Black calls the claims in the book "outrageous evidence of jury misconduct."

Judge Colbath could rule any time now on the defense's motion for a new trial.

Goodman was convicted of DUI manslaughter in March. He killed Scott Wilson, 23, in a car crash in 2010.
