PALM BEACH COUNTY, Fla. - Polo mogul John Goodman's adoption of his girlfriend won't stand.
The Third District Court of Appeal issued an opinion Wednesday that set aside the adoption of Heather Colby Hutchins.
His attorney at the time the adoption became public said, "Everything that has been done by Mr. Goodman was done with the intention to preserve and grow the assets of the Trust for his two minor children, even should he personally be unable to continue his historical role in achieving these goals."
But the appeals court found Goodman failed to provide notice of the adoption to his children's guardian and mother Carroll. It said that "constituted fraud on the court."
In the opinion Senior Judge Alan R. Schwartz said, "Even if the motivation and the means for securing it were not so reprehensible, I believe... the adoption of a paramour is so contrary to the beneficent purposes of such an action that no such judgment can ever be sustained."
Forty-nine-year-old Goodman founded the International Polo Club in Palm Beach. Last year he was sentenced to 16 years in prison for a fatal drunken-driving crash.
