James Holmes, Aurora theater shooting suspect, formally charged with murder

DENVER -- Launching a case that legal analysts expect to be dominated by arguments over the defendant's sanity, Colorado prosecutors filed 24 counts of first-degree murder and 116 counts of attempted first-degree murder against James Eagan Holmes, the former neuroscience student accused of killing 12 people and wounding 58 others at an Aurora movie theater.

Twelve people were killed and 58 were wounded or injured in the shooting that happened July 20. The breakdown of the charges was not immediately clear.

Holmes wore a red jumper and was handcuffed during the hearing. His hair was matted down and wavy, said 7NEWS reporter Marshall Zelinger. He only said one word during the 45 minute hearing saying "Yes" to his attorney regarding a question about scheduling.

Zelinger said Holmes was more composed during last Monday's hearing when he appeared bleary-eyed and distracted.

"Nothing really compared to what we saw last week. He was almost like a different person," Zelinger said.

Cameras were not be allowed in the courtroom during Monday 9:30 a.m. hearing where attorneys also argued over a defense motion to find out who leaked information to the news media.

The information included details about a package the 24-year-old former graduate student allegedly sent to his psychiatrist at the University of Colorado Denver.

Authorities seized the package July 23, three days after the shooting, after finding it in the mailroom of the medical campus where Holmes studied.
